  Hello,

  It’s not related to our theme, WooCommerce plugin does not have checkboxes there by default, you can enable the Storefront theme (The Official WooCommerce Theme https://woocommerce.com/storefront/ ) and check how it works.

  It appears once you choose the Privacy policy page in Customizer > WooCommerce > Checkout settings https://prnt.sc/11t4sdi So, choose the correct page or edit the one that I created.
